Dependent visa or Spouse Visa is mainly for Spouse/Partner and Children of main applicant having temporary residence status in Canada either on Study permit, Post study work permit or Work permit.

1. H-4 VISA (Dependent Visa)
H 4 visa is for dependent family members of H1 visa holders; main applicant and spouse can submit application together or once main applicant is in USA then spouse can also apply. Dependents are not authorized to work in USA.

Documents showing financial status, savings and living for period of stay are required along with evidence of genuine relationship with spouse. The applicant needs to fill DS 160 form and also attend interview at embassy with original documents.

H-4 Visa processing time

The processing time varies from 4 weeks to 5 weeks.

2. Green Card

Who are eligible to apply

  • Immediate relative of USA citizen
  • Preferred relative of USA citizen or Greencard holder
  • Accompanying relative of some in a preference category

If USA citizen and applicant is in USA then form I 130 is required to be filed, a petition for alien relative and form I 485.
If spouse is outside of USA, Form I-130 needs to be filed, a petition for Alien Relative. When I-130 is approved it will be sent for processing by consular and notification will be placed.
In case of a Green cardholder Permanent Resident inside USA the applicant needs to file I -130 after visa number is available for Permanent residency and I -485.
For Green Card holder permanent Resident outside USA, application needs to file I-130. Once approved it is sent for consular approval.

Documents required for Greencard


Form I-130 (signed with proper fee), with all required documentation, including:
  • Two completed and signed G-325A forms. (one for you and one for your spouse)
  • A copy of your civil marriage certificate.
  • A copy of all divorce decrees, death certificates, or annulment decrees that demonstrate that all previous marriages entered into by you and/or your spouse were terminated.
  • Passport style photos of you and your spouse. (see Form I-130 instructions for photo requirements)
  • Evidence of all legal name changes for you and/or your spouse. (may include marriage certificates, divorce decrees, court judgment of name change, adoption decrees, etc.)

If you are a U.S. citizen, you must demonstrate your status with:
  • A copy of your valid U.S. passport OR
  • A copy of your U.S. birth certificate OR
  • A copy of Consular Report of Birth Abroad OR
  • A copy of your naturalization certificate OR
  • A copy of your certificate of citizenship

If you are a green card holder (permanent resident), you must demonstrate your status with:
  • A copy (front and back) of Form I-551 (green card) OR
  • A copy of your foreign passport bearing a stamp showing temporary evidence of permanent residence.
